The American Health Care Association and National Center for
Assisted Living (“AHCA”) believe in a clear disclosure of how any websites,
mobile applications, research tools or other online services we provide
(collectively, our “Services”) may collect and use your personal information.
We therefore provide this Privacy Policy to describe the types of information
we may collect, how such information can be used, stored and safeguarded, and
when we may share it with our affiliates or third parties. This Privacy Policy applies to all visitors,
users, and others who access our Services (“Users”). A number of the more advanced features,
search tools or data feeds in our Services may require registration.
Please
check this page periodically so that you are aware of any changes to this
Privacy Policy, which we may revise from time to time in our sole
discretion. All changes are effective
immediately upon posting, and continued use of the Services following the
posting of a revised Privacy Policy means that you accept and agree to those

What information do we collect?
Through our Services, we may collect the following types of

2.1. Personal
information you provide to us
This can include emails to us, filling out online forms, or
by otherwise providing your information.
Examples include: (i) a username and password, name, contact information
(e.g., address, phone number, email) and payment information, such as when
creating or updating your account, using the Services, placing an order, or
entering an event, contest or sweepstakes; (ii) content (e.g., photos,
comments, and other materials) that you provide to us, along with any
information you provide about yourself and the content (collectively, “User
Content”); and (iii) information in communications between us. Please note that uploaded User Content may
also contain technical “metadata” which may, for example, indicate how, when,
where and by whom a piece of User Content was collected and how that content is
formatted. Some of the Services may
collect related forms of information, for example, we may collect information
about gift recipients to fulfill gift purchases.
2.1. Analytics
tools and log information
We may use proprietary or third-party analytics tools to
help measure traffic and usage trends for our Services. These tools collect
information sent by your device or the Services, including the web pages you
visit, add-ons, and other information that assists us in improving the
Services. This analytics data is typically aggregated and does not identify any
particular User. Our Services may also
maintain log data generated when using the Services, such as web requests,
Internet Protocol (“IP”) addresses, browser type, URLs, pages viewed, and other
such information. We may collect similar information from emails sent to our
Users to better track which emails are opened and which links are clicked by
recipients.
2.2. Cookies
and similar technologies
We may use cookies or other similar technologies like
pixels, web beacons, and local storage to collect information about how you use
the Services and provide features to you.
We may permit advertisers or other partners to serve ads or services to
you, which may also use cookies or similar technologies placed by us or the
third party. Please note that you may be
able to set your browser or device to prompt you before you accept a cookie,
accept cookies automatically or reject all cookies. However, if you choose not
to accept cookies from the Services, you may not be able to access and use all
or parts of the Services or benefit from the information and features that we
offer.

How do we use your personal information?
In addition to some of the specific uses of information
described in this Privacy Policy, we may use information received through the
Services to: (i) provide our products or Services online or offline; (ii) help
you efficiently access and manage your information, provide you with customer
support, and perform other functions described to you at the time of collection;
(iii) remember certain information so you will not have to re-enter it during
your visit or the next time you visit the Services; (iv) provide personalized
content and information to you and others, which could include various forms of
marketing; (v) provide, improve, develop, test, diagnose or fix, and monitor
the Services or features; (vi) enforce or exercise any rights in our Terms and
Conditions; and (vii) monitor metrics such as total number of visitors,
traffic, and demographic patterns.
We may communicate with you concerning: (i) your account;
(ii) your use of any of the Services; (iii) Service updates or announcements;
or (iv) for technical or customer support purposes. Unless you notify us otherwise, we may also
communicate with you about various Services or other that may be of interest to
you.

When do we share collected information?
We will not give, share, sell, or transfer any of your
personal information to third parties (beyond our legal affiliates) without
your consent, except as noted in this Policy.
4.1. Third
parties with whom we may share information
We may share your information with third-parties that help
us provide the Services or other AHCA products or services to you (“Service
Providers”). They will be given access
to information as necessary to fulfill this purpose under reasonable
confidentiality terms.
From time to time, we may share some of your personal
information with our sponsors, conference exhibitors, and other business
partners so that they may offer you goods or services that may be of interest
to you. We may also share certain
information such as cookie data with third-party advertising partners. This
information would allow third-party ad networks to, among other things, deliver
targeted advertisements that they believe will be of most interest to you.
We may remove parts of data that can identify you and share
anonymized data with other parties, or combine your information with other
information in a way that it is no longer associated with you and share that
aggregated information.
4.2. What
happens in the event of a change of control
If we transfer part or all of our assets to another
organization, your personal information and any other information collected
through the Services may be among the items transferred. The buyer or
transferee will have to honor the commitments we have made in this Privacy
Policy.
4.3. Responding
to legal requests and preventing harm
We may access, preserve and share your information when we
have a good faith belief it is necessary to: (i) respond to a legal request
(like a search warrant, court order or subpoena) or otherwise comply with the
law; (ii) detect, prevent and address fraud and other illegal activity, or
violations of our terms and policies; (iii) to protect us, you and others,
including as part of investigations.
4.4. Message
Boards & Other Public Forums
As a service to our users, we feature several public message
boards, blogs and other public forums where users can share information and
interact with each other via our Services. Please think carefully before
disclosing any of your information or User Content in any public forum, because
it is by design accessible to the public, is not a private or secure
environment, and may be collected and used by third parties.
4.5. AHCA
data collection and reporting tools
When you use AHCA data collection and reporting tools, you
may be required to classify and identify data you submit via the tools as
general data that we are permitted to disclose to all users of the Services, in
the aggregate, or data that should only be accessible to your permitted group
of users (e.g., facility specific users). In some instances, the very tools and
applications through which the data is submitted will indicate the nature
thereof without any further requirements on your part. However, if you are
prompted to identify the nature of the data and fail to do so, AHCA may make
the data available on a general aggregate basis, for which it shall have no
liability and you shall have no recourse against the AHCA.
4.6. Market
Research
An important aspect of our Services is market research in
areas of health and long-term care. We gather this information from a variety
of sources including publications, research papers, surveys, focus groups and
member/user contributions. This information is used for subscriber industry
research purposes and not for sale or other commercial purposes.
An important feature of our Services is the ability for you
to submit certain industry information for others to review, and in return,
allow you to view their industry information. All such information will be
presented via the Service in an aggregate statistical form without any
identifiable information, but we cannot warrant the confidentiality and/or
anonymity of this information. You disclose this information at your own risk.
We may disclose this non-identifiable, aggregate data to
select partners and other third parties, but require those recipients to agree
they will not commercially exploit or attempt to make the data identifiable,
such as by combining it with other databases.
5. Links to other websites or services
We may, from time to time, allow third parties to offer
services to you on our Services. For
example, we may allow social networking websites to control a portion of our
webpage (i.e., a portal) through which you can interact with the third party,
its services, servers, and other users.
We may also allow for multi-party engagement tools (e.g. online
collaboration services) to facilitate our members and Users working together on
initiatives of interest. Unless it is obvious, we will generally indicate where
such a third party, and not us, controls a particular area of a website.
AHCA is not responsible for the practices employed by any
other websites or services linked to or from our Services or provided in such
portals, including the information or content contained within them or
information collected by them. Our Privacy Policy does not apply to those
third-party websites, services or portals, which are subject to that third
party’s own rules and policies. You agree that AHCA is not responsible and does
not have control over any third parties that you authorize to access your User
Content or personal information, nor do we provide any representation or
warranty regarding accuracy of information provided by such third parties, the
security of the third party’s services, or your ability to access and use their
services. If you are using a third-party website or service and you allow them
to access your User Content or personal information, you do so at your own
risk.
6. How do we protect your information?
We may use information we collect from you anywhere in the
world where we or our Service Providers maintain facilities. We use
commercially reasonable safeguards to help keep the information collected
through the Services secure and take reasonable steps to protect your personal
information. However, we cannot ensure the security of any information you
transmit to us or guarantee that information stored on the Services may not be
accessed, disclosed, altered, or destroyed.
You agree that we may communicate with you electronically
regarding security, privacy, and administrative issues, such as security
incidents. We may post a notice on our Services if an incident occurs, and may
communicate with you at the email address you provided.
Please do your part to help us. You are responsible for
maintaining the secrecy of any non-public information that you provide,
accessing the Services only from a secure device and network connection, and
controlling access to emails between us. Internet e-mail may not be secure.
Your information may also be affected by your use of social media services
(e.g., Facebook, Twitter) that may be featured on the Services (e.g., social
links), or by social media services that you are connected with when accessing
the Services. We are not responsible for the functionality, privacy, or
security measures used by you or other organizations.
7. Data accuracy
Please note that you are responsible for providing your most
current, accurate and information to us upon registration or when updating an
account. By doing so, you may be able to access and use certain advanced
database applications and search tools, subscribe to newsletters and use other
Services not otherwise available to non-registered users. The personal
information we collect may include information about your organization that we
require to give you access to AHCA-provided data collection and reporting
tools. You represent and warrant that, under no circumstances shall any information
you submit to the Services be inaccurate, misleading, obtained in an
unauthorized manner, or a violation of any applicable law.
8. Choices about you information
If you have an online account with any of our Services, you
may have the ability to review, update or delete some of your personal
information, or modify your e-mail subscriptions or other communication
settings, by logging into your account on the Services. Certain information that you provide to the
Services may be retained indefinitely, consistent with our Terms and
Conditions. However, we generally retain
personal information as needed for business and legal purposes, in accordance
with applicable contractual and legal requirements, and consistent with our
document retention practices. Please contact us with any inquiries about your
personal information used by the Services.
You can unsubscribe and opt out of receiving most of our
communications with the “unsubscribe” link at the bottom of any email
newsletter or other email communication.
You can also contact the webmaster or technical support staff as

out of certain Services- or account-related communications (e.g., account
updates, transaction confirmations, technical and security notices).
9. Special Notice Regarding Children’s Privacy
We do not knowingly solicit, collect, store, use or disclose
personal information online from anyone under 13 years old or knowingly permit such
persons to use the Services. If we learn of such information being obtained, we
will delete it as quickly as possible. If you become aware of such an
occurrence, please email us at update@ahca.org.
10. Do Not Track
Some web browsers offer a Do Not Track (“DNT”) setting that
can signal websites or services that the user does not want certain information
about webpage visits collected over time and across websites or online
services. Irrespective of DNT signals,
we handle all user information consistent with our Terms and Conditions and
this Privacy Policy.
